PRO GOLF X VENTURES INC. 

Terms & Conditions and Waiver of Liability 

By clicking “I Agree” or completing a booking, you confirm that you have read, understood, and agree to the following legally binding terms. 

If you sign this agreement electronically and bring a minor (anyone under 18 years old), you confirm that the minor is bound by these same Terms and Conditions. You accept full legal responsibility for the minor and for the minor’s behaviour while at the facility. 

1. Assumption of Risk & Full Release of Liability 

PRO GOLF X VENTURES INC. (“PRO GOLF X”) is an unstaffed, 24/7 indoor golf simulator facility. You understand and agree that you are using the facility entirely at your own risk. 

Indoor golf involves inherent risks, including but not limited to: 

  • Injury from swinging golf clubs 
  • Being struck by golf balls (including ricochets) 
  • Slips, trips, and falls 
  • Equipment malfunction or failure 

You voluntarily assume all risks of injury, death, property damage, or loss arising from your use of the facility. 

To the fullest extent permitted under the laws of Alberta, you release and waive any and all claims against PRO GOLF X, its owners, directors, employees, contractors, and affiliates for any injury, death, or damage — including claims caused by the company’s negligence or breach of duty of care. 

You agree that you will not sue or make any legal claim against PRO GOLF X for any reason related to your use of the facility. 

2. Indemnification 

If your actions — or the actions of a minor or guest you bring — cause damage, injury, or a legal claim against PRO GOLF X, you agree to fully indemnify and reimburse PRO GOLF X for any legal fees, damages, or costs incurred. 

3. Unattended Facility & Conduct 

  • PRO GOLF X is unstaffed. You are responsible for your own safety at all times. 
  • In an emergency, you are responsible for calling 911. 
  • The facility is under 24/7 video surveillance. By entering, you consent to being recorded. 
  • You may not share your access codes with anyone. 
  • You are financially responsible for any damage caused by misuse, negligence, or rule violations. 

Alcohol Policy 

PRO GOLF X is not licensed to sell or serve alcohol. Bringing, consuming, or being under the influence of alcohol at the facility is strictly prohibited at all times. Violation of this rule may result in immediate cancellation of access without refund and potential permanent suspension. 

Respect & Behaviour 

You agree to respect the space, safety, and enjoyment of others at all times. Aggressive, threatening, abusive, or unsafe behaviour toward anyone will not be tolerated and may result in immediate removal, cancellation of access without refund, and possible permanent ban. 

4. Minors & Guests 

  • Anyone under 18 must be supervised at all times by a parent or legal guardian. 
  • If you sign on behalf of a minor, you accept all risks and legal responsibility for that minor. 
  • You are responsible for all guests you bring into the facility. 

5. Coach Terms & Conditions

The following additional terms apply to any coach, instructor, trainer, academy operator, or person conducting paid or unpaid instruction (“Coach”) at PRO GOLF X.

Coach Eligibility

By using the facility for coaching, the Coach represents and warrants that they:

  • Are in good professional standing
  • Hold all certifications, qualifications, or credentials required to provide golf instruction
  • Maintain any required professional memberships or coaching accreditation
  • Have successfully completed a valid criminal record / police background check suitable for working with minors, where applicable
  • Are legally permitted to provide coaching services in Alberta

PRO GOLF X may request proof of credentials, certification, insurance, or background checks at any time.

Failure to provide satisfactory documentation may result in immediate suspension or termination of facility access.

Independent Contractor Status

Coaches are independent users of the facility only.

PRO GOLF X does not employ, supervise, endorse, certify, or control any coach’s instruction, programs, methods, or business operations.

No coach may represent themselves as an employee, agent, partner, or official representative of PRO GOLF X unless expressly authorized in writing.

Coach Responsibility for Students

The Coach accepts full responsibility for:

  • Student safety
  • Student supervision
  • Student conduct
  • Safe use of golf clubs, balls, simulators, and facility equipment
  • Ensuring all participants understand and follow facility rules

If minors are being coached, the Coach accepts full supervisory responsibility while the minors are under their care.

Coach Liability

The Coach assumes full responsibility for all risks associated with coaching activities.

The Coach agrees to indemnify and hold harmless PRO GOLF X against any claims, injuries, disputes, damages, or liabilities arising from:

  • Coaching services
  • Student injury
  • Student misconduct
  • Negligent supervision
  • Misrepresentation of qualifications

Insurance

PRO GOLF X requires that all coaches maintain their own professional liability insurance and general liability coverage.

6. Health & Personal Property 

You confirm that you are physically able to participate in golf-related activities. 

PRO GOLF X is not responsible for lost, stolen, or damaged personal items, including clubs, phones, bags, or other belongings. 

7. Media Release 

You grant PRO GOLF X permission to use video or images captured by security cameras for marketing or social media purposes. 

If you wish to opt out, you must email support@progolfx.com before your booking. 

8. Governing Law 

This agreement is governed by the laws of Alberta, Canada. 

By clicking “I Agree,” you acknowledge that: 

  • You understand this is a waiver of legal rights. 
  • You are giving up your right to sue. 
  • This agreement is legally binding as if you signed a paper contract.
